Answer
In April 2014, the United States Federal Communications Commission (FCC) adopted a rule change for devices that impact 802.11 wireless LAN 5 GHz bands equipment sold in the United States. The new rules are effective on June 2, 2016.

Some legacy 802.11 access points require new firmware and FCC grants.

Access points shipped after June 2, 2016 will be released with compliant firmware, WiNG version 5.8.3.9 or greater.

Due to the new ruling - action was to release new firmware into the factory and upgrade any APs in current distribution with the WiNG 5.8.3.9 maintenance release.

Access points that shipped from a legacy distribution centers on or after June 2, 2016 will include the WiNG 5.8.3.9 or greater firmware.
